Pamela Smart, convicted of conspiracy to commit the 1990 murder of her husband and sentenced to life without parole, is seeking an opportunity for a commutation hearing before the state’s Executive Council, her lawyer confirmed Tuesday.
Attorney Mark Sisti asked the state Supreme Court Tuesday to order the Executive Council to hold a full hearing on Pamela Smart’s commutation petition – and provide her with at least a little hope.
She has asked Associate Attorney General Strelzin, Governor Christopher Sununu and the New Hampshire Executive Council to have mercy on her and reduce her sentence so that she can one day return home. Unfortunately, mercy does not seem to be in their cards. Pam can only hope that they take another look at what rehabilitation really looks like.
Pamela Smart’s request for a commutation hearing on her life in prison accessory to murder conviction was unanimously rejected by the state’s Executive Council Wednesday.
The state won’t review Pam Smart’s conviction as suggested by her attorney Mark Sisti after new information came to light last week about Paul Maggiotto, the now-Concord attorney who prosecuted her in 1991, according to Deputy Attorney General Jane Young.
Pam Smart’s lawyer says the state should review her case after a Brooklyn, N.Y., judge tossed a murder conviction Friday won decades ago by attorney Paul Maggiotto who also prosecuted Smart, her ex-teen lover and three friends for the 1990 murder of her husband, Gregory Smart in Derry.
According to Associate Attorney General Jeffery Strelzin, should the Executive Council agree to hear Smart’s request and if it were to agree to grant her a commutation, she could be eligible for parole in the future.
