OSSIPEE – A Carroll County jury on Thursday found William Kelly of Ossipee guilty of two counts of second-degree murder in connection with the Dec. 17, 2023, deaths of Christine Falzone, 33, and her unborn child, according to a news release from Attorney General John Formella.
The evidence presented at trial established that Kelly assaulted Falzone inside the couple’s residence in Ossipee, causing injuries that resulted in the deaths of both Falzone and her nearly full-term unborn child.
“This case marked the first prosecution under New Hampshire law allowing a murder charge for the death of a fetus,” the release said.
After conducting an autopsy on Dec. 18, 2023, Deputy Chief Medical Examiner Dr. Mitchell Weinberg determined that Falzone was approximately 35-37 weeks pregnant at the time of her death.
“Our thoughts remain with Christine Falzone’s loved ones, who have endured an unimaginable loss,” Formella said. “We are grateful for our dedicated trial team, the diligent investigators who worked this case, as well as for the careful work of the jury throughout this trial. Domestic violence can have devastating and irreversible consequences, and we hope this verdict provides a measure of justice for Christine and her unborn child.”
Sentencing will be scheduled by the Carroll County Superior Court on Aug. 10 at 1 p.m.
According to authorities, on Dec. 17, 2023 at about 11:44 a.m., a 911 call was made for a report of a woman unconscious and not breathing at 332 Water Village Road in Ossipee.
Officers and paramedics responded to that location and encountered Christine Falzone with multiple injuries and Falzone was ultimately pronounced dead.
Responding officers also encountered Kelly at the same location and he was taken into custody.
