Attorney General John M. Formella announces that on March 16, 2023, pursuant to a negotiated agreement, former Concord Police Officer Michael Kosa, age 32, of Manchester, pleaded guilty in the 6th Circuit–District Division–Concord to two class B misdemeanors for violations of Records and Certification, RSA 260:14, IX(a), commonly known as the Driver Privacy Act.
The first complaint stated that on July 13, 2022, Mr. Kosa queried the name and date-of-birth of an individual he knew through the State Police Online Telecommunication System (“SPOTS”), and then knowingly used information obtained from Department of Safety–Division of Motor Vehicle (“DMV”) records for a non-law enforcement purpose other than what is authorized by the Department of Safety.
The second complaint stated that on September 19, 2022, Mr. Kosa queried a license plate number belonging to this same individual through SPOTS, and then knowingly used information obtained from DMV records for a non-law enforcement purpose other than what is authorized by the Department of Safety.
As part of the negotiated resolution, Mr. Kosa will be fined $1,200 for each offense with all but $500 suspended for a period of two years. In addition, Mr. Kosa agreed to resign from the Concord Police Department, surrender his New Hampshire Law Enforcement Certification, and not seek further employment in law enforcement. He also agreed to not contest his placement on a national registry of decertified officers or on the New Hampshire Attorney General’s Exculpatory Evidence Schedule (EES).
If Mr. Kosa violates any of the above conditions within two years of the date of sentencing, the State may seek to impose the suspended portion of his negotiated sentence and reserves the right to bring forward additional charges.
This case was investigated and prosecuted by members of the Attorney General Office’s Public Integrity Unit, with assistance from Concord Police Department and the New Hampshire State Police. The Public Integrity Unit investigates and prosecutes allegations of criminal conduct committed by state officials and law enforcement officers in the State of New Hampshire.
