UPDATE: Justice Anna Barbara Hantz Marconi’s jury selection has been scheduled for Nov. 4 at 9 a.m. with the jury trial scheduled for Nov. 17, 18 and 19 starting each day at 10 a.m.
CONCORD – Judge Martin Honigberg granted state Supreme Court Justice Anna Barbara Hantz Marconi’s motion to postpone her criminal trial on Thursday and said the hearing that was scheduled for Friday on motions will also be held later in Merrimack County Superior Court.
The Attorney General’s Office withdrew its objection to Hantz Marconi’s motion to postpone the trial in a filing Thursday.
“In light of the State’s notice of ‘no position’ on the Defendant’s motion to continue the trial, the Court has reviewed the motion and agrees that the trial should be continued,” Honigberg wrote in an order released Thursday.
The hearing on Hantz Marconi’s Renewed Motion to Disqualify the Attorney General and dismiss the indictments against her, and the State’s Motion to Quash the subpoena for Attorney General John Formella to testify will be rescheduled for the week of Sept. 2, the order stated.
Honigberg said responses to the Motion to Clarify filed by the Judicial Branch will be due Aug. 22, and that motion will be considered at the same hearing. He said the Clerk will contact counsel about the specific date and time for the motions hearing in September and about rescheduling the trial in November.
Hantz Marconi, 69, of Stratham, is accused of having conversations with then-Gov. Chris Sununu in June 2024 and Stephen Duprey, chairman of the Pease Development Authority, in April 2024 trying to influence a criminal investigation into her husband, state Ports Director Geno Marconi, 73. She and her husband remain on paid leave from their positions.
In a motion seeking postponement filed last week, Hantz Marconi’s attorney Richard Guerriero said there “are too many moving parts,” to proceed to trial with 10 pending motions before the court and some questions about discovery being turned over.
Guerriero also said the defense will likely seek pretrial review from the state Supreme Court.
He also said the state hasn’t turned over all the requested discovery, documents that are shared between prosecutors and the defense before trial.
“For example, since October of 2024, the defense has been asking the State to produce records of Sununu’s meetings with other judges or justices. In writing, the State has twice denied possessing such evidence. Yet, the discovery produced by the State indicates that such meetings occurred,” Guerriero wrote.
He said one document mentions Sununu meeting with Supreme Court Chief Justice Gordon MacDonald during a swearing in ceremony, and Sununu acknowledging meeting with justices, including former Justice Gary Hicks.
Because MacDonald and the three other Supreme Court justices are expected to testify at Hantz Marconi’s trial, if Guerriero seeks pre-trial Supreme Court review, a separate panel will have to be appointed.
Hantz Marconi’s husband, Geno Marconi, 73, of Stratham, was indicted for allegedly falsifying physical evidence by deleting a voicemail/and or voicemails from a phone on April 22, 2024.
He was also indicted for allegedly retaliating against Pease Development Authority Board Vice Chairman Neil Levesque, who is also the director of the New Hampshire Institute of Politics at Saint Anselm College, by providing confidential motor vehicle records pertaining to Levesque to Bradley Cook, in violation of the Driver Privacy Act. Geno Marconi is challenging those indictments.
Geno Marconi’s trial is scheduled for Nov. 2. Bradley Cook was indicted for allegedly lying to the grand jury investigating Marconi. Juror selection in Cook’s trial is scheduled for Jan. 5, 2026.
